MARIJUANA BUSINESS ESTABLISHMENT LICENSE INFORMATION
THE FOLLOWING INFORMATION IS INTENDED TO PROVIDE GENERAL INFORMATION - GUIDELINES AND SHOULD NOT BE CONSTRUED AS LEGAL ADVICE OR AS A SUBSTITUTE FOR LEGAL COUNSEL.
COUNTY STAFF MEMBERS ARE NOT PERMITTED TO PROVIDE LEGAL ADVICE REGARDING THE MARIJUANA BUSINESS LICENSE PROCESS
A SEPARATE LICENSE OPERATING FEE IS REQUIRED FOR EACH LICENSE TYPE. ALL FEES ARE NON-REFUNDABLE
Marijuana Business licenses are issued by dual licensing authorities; obtaining a Marijuana business license is a privilege, not a right. The State of Colorado and Archuleta County Marijuana Code and Rules and Regulations, regulate marijuana business licenses, and it is the Applicant's burden to understand and comply with those laws and regulations.
A separate application and approval is required by the State of Colorado, and any license issued by the Archuleta County Marijuana Authority is contingent upon the appropriate State licensure. The purpose for this application is to comply with the Archuleta County Marijuana Licensing Regulations.
It is recommended that Applicants familiarize themselves with Archuleta County regulations relating to Marijuana, including zoning codes, building codes, and licensing regulations.
It is the Applicants’ responsibility to research and identify any school, licensed child care facilities, church or dedicated public park within 1000 feet of the property (measured from property line to property line) where the retail marijuana business and medical marijuana business is seeking to be licensed. Failure to identify any of the above may result in revocation of license. Should a survey be required to verify proper distance, the cost will be the responsibility of the Applicant.
It is the Applicants’ responsibility to research and identify any residential or planned unit development zoned areas within 250 feet of the property (measured from property line to property line) where the retail marijuana business or medical marijuana business is seeking to be licensed. Failure to identify any of the above may result in revocation of license. Should a survey be required to verify proper distance, the cost will be the responsibility of the Applicant.
No license will be issued until all applicable fees have been paid by business check or certified funds, and all required licenses have been obtained. New or transfer operating fee is valid for all license types. A separate operating fee is required for each license type. Subsequent applications for additional locations require an additional fee. All fees are non-refundable.
Any local license issued under these regulations shall be valid for a period of one (1) year from the date of issuance and shall terminate on the same date as the State Licensing Authority’s license. Applications for renewals shall be processed in the same manner as new licenses. Any changes, alterations, or modifications must be shown on renewal applications. Applicants shall submit a renewal application at least sixty (60) days before the expiration of the license. Archuleta County shall not notify license holders of the expiration date.
If the application is approved by Archuleta County, Applicants will receive an Approval Letter that Applicant may use to obtain a State License. Upon the issuance of the State License, the Applicant shall provide a copy to Archuleta County whereupon the official Local License will be issued. The Applicant shall NOT begin any business operation for the purpose of cultivation, manufacture or sale of medical marijuana, retail marijuana or medical marijuana infused products until after licenses have been issued by both the State of Colorado and Archuleta County. Both licenses must be posted in a conspicuous location, visible to the public within Retail Marijuana Establishment, Medical Marijuana Establishment and immediately within the front door of Medical Marijuana Optional Premise Cultivation Operation, Retail Marijuana Optional Premise Cultivation Operation, Medical Marijuana Infused Product Manufacturers and Retail Marijuana Infused Product Manufacturers.
